Nicholas Daniel Brown (“we,” “us,” or “our”) is a real estate licensee affiliated with Compass, a licensed real estate broker. This Privacy Policy explains how we collect, use, share, and protect information when you visit this website (the “Site”) or otherwise communicate with us.

1. Information We Collect

Information you provide directly, such as when you submit a contact form, inquire about a property, use the Finding Home questionnaire, or otherwise communicate with us:

  • Name
  • Email address
  • Phone number
  • Property or message details you choose to share

Information collected automatically, when you use the Site:

  • IP address, browser type, device type, and operating system
  • Pages viewed, time on site, and referring URLs
  • Cookies and similar tracking technologies (see Section 4)

We do not knowingly collect Social Security numbers, financial account numbers, or other sensitive government identifiers through this Site.

2. How We Use Your Information

  • Respond to your inquiries and provide the real estate services you request
  • Send you property information, market updates, or other communications you’ve agreed to receive
  • Improve and maintain the Site
  • Comply with legal and MLS/brokerage obligations
  • Detect and prevent fraud, spam, or abuse of our forms and systems

We do not use automated decision-making technology to make decisions that produce legal or similarly significant effects concerning you.

3. Text Messaging (SMS) Communications

If you provide your phone number and affirmatively opt in through a form on this Site, you agree to receive calls and text messages from Nicholas Daniel Brown | Compass regarding your inquiry, using automated technology where applicable.

  • Consent to receive text messages is never a condition of using the Site or of purchasing any service.
  • Message frequency varies based on your inquiry and any communications you request.
  • Message and data rates may apply.
  • You may opt out of text messages at any time by replying STOP to any message, or by contacting us using the information in Section 11.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories of information sharing described in this policy exclude text messaging originator opt-in data and consent. That information is not shared with any third party for any purpose.

4. Cookies and Tracking Technologies

We may use cookies, pixels, and similar technologies (including tools such as Google Analytics) to understand how visitors use the Site and to improve its performance. You can control cookies through your browser settings; disabling cookies may affect Site functionality.

Where required by law, we honor recognized opt-out preference signals, including Global Privacy Control (GPC), as a valid request to opt out of the sale or sharing of personal information for that browser or device.

5. How We Share Your Information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising.

As stated in Section 3, this does not include sharing SMS opt-in consent data with third parties for marketing purposes.

6. Data Security

We use reasonable administrative, technical, and physical safeguards to protect the information we collect. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

7. Data Retention

We retain personal information for as long as reasonably necessary to respond to your inquiry, provide the services you request, and satisfy the purposes described in this policy. As a general matter:

  • Contact form and inquiry data is retained for up to 3 years from your last interaction with us, unless you request earlier deletion or an active client or legal relationship requires longer retention.
  • Transaction-related records are retained as required by Georgia real estate licensing law and Compass brokerage recordkeeping requirements, which may extend beyond 3 years.
  • Automatically collected analytics data is retained according to the retention settings of the analytics tools we use, generally no longer than 26 months.

8. Your Privacy Rights

Depending on your state of residence, you may have the right to:

  • Know what personal information we have collected about you and why
  • Access a copy of that information
  • Correct inaccurate personal information
  • Delete personal information we hold about you, subject to legal exceptions
  • Opt out of the sale or sharing of personal information, or targeted advertising (we do not currently engage in either)

To exercise any of these rights, contact us using the information in Section 11 with the subject line “Privacy Rights Request.” We will verify your request and respond within the timeframe required by applicable law. You will not be discriminated against for exercising any of these rights.

This Site is not directed to children under 13, and we do not knowingly collect personal information from children.

9. Gramm-Leach-Bliley Act (GLBA) Notice

To the extent any portion of our services is deemed to involve nonpublic personal information under the Gramm-Leach-Bliley Act, we limit our use and sharing of that information to what is necessary to provide the services you request, and we do not share it with nonaffiliated third parties for their own marketing purposes.

10. Third-Party Links

The Site may contain links to third-party websites (including MLS listing pages or partner sites). We are not responsible for the privacy practices or content of those sites.

12. Changes to This Policy

We may update this Privacy Policy from time to time. The “Effective Date” above reflects the most recent revision. Material changes will be reflected by an updated Effective Date, and a summary of prior versions is available upon request. Continued use of the Site after changes constitutes acceptance of the updated policy.
